Ofcom market study into the pay TV industry

Ofcom announcement that, at the request of Sky's main competitors, it will conduct a market study into the pay TV industry. This could lead to a Competition Commission market investigation, or to enforcement action under the Competition Act 1998, Article 82 or the Communications Act 2003.

The study is triggered by the dispute between Sky and Virgin about the price paid by the cable operator for Sky's entertainment channels, and by Sky's proposed launch of pay TV services on digital terrestrial television.

The study is a "separate process" from Ofcom's investigation into Sky's shareholding in ITV plc. The statement does not disclose how the study will interact with proposals to regulate third-party access to Top Up TV or with the study into TV platform regulation and competition initiated by Ofcom in 2006.
