ORR proposes modest changes to railway licenses

ORR consultation (43 pages, PDF) on proposed changes to existing and template licences. The main changes would be for train operator licences, which would include more demanding financial fitness requirements so that the "fitness to operate" conditions of current licences can become an authorisation recognised throughout the EEA. The procedure under licences for ORR to prohibit specific practices amounting to the exclusionary abuse of a dominant position would be removed, as would the various "accounting separation" and/or "cross-subsidy" obligations of station, depot and some train operators. The document also proposes reviews of third-party liability arrangements and of environmental policy guidance at some point over the next few years. Responses by Friday 11 November 2005.
