EWS agrees to findings of abuse of dominant position

ORR notice that EWS has agreed to ORR findings that it had abused a dominant position by entering into contracts for coal haulage which had an exclusionary effect on other freight operators, and by engaging in "discriminatory and predatory pricing practices" in coal haulage. This follows from an investigation into complaints made by competitors in 2001 and 2002. ORR has decided to impose a financial penalty of £4.1 million. The decision setting out the findings of infringement and the calculation of the penalty is to be published "in due course".
