Merger control process for Stagecoach / South Western

OFT notice that the anticipated award of the South Western passenger rail franchise to Stagecoach is being considered under the merger control rules.

Stagecoach already runs all the relevant services (South West Trains and Island Line) but Section 66(3) of the Railways Act 1993 requires the award of the franchise to be examined under the Enterprise Act 2002 as if it were a new acquisition: see GB passenger rail franchise merger control rules and this Reckon paper (9 pages, PDF).

In line with newly agreed arrangements, this notification was only made after the Department for Transport had chosen Stagecoach to run the franchise. Comments to the OFT by Monday 20 November 2006.
