Welsh Water appeal against Albion Water CAT judgments

Court of Appeal order (4 pages, PDF) granting leave to appeal to Dŵr Cymru Welsh Water against the Competition Appeal Tribunal judgments in its dispute against Albion Water over charges for the use of Welsh Water's infrastructure to supply water to the Shotton Paper factory in South Wales.

The scope of the appeal is limited to two questions:

This order, made on Thursday 26 July 2007 but only published (on the Tribunal's website) on Thursday 16 August 2007, partially reverses the refusal of leave to appeal on the papers in April 2007. The reasoned judgment does not appear to be publicly available at present.

A two-day hearing in the Court of Appeal is to be expedited, and "if possible" scheduled in Autumn 2007. The order invites written submissions from OFT and all regulators with concurrent competition law enforcement powers (including Ofwat, which was heard in connection with the application for permission to appeal).
