Procedures for directing railway enhancements

ORR code of practice (28 pages, PDF) for the application of Sections 16A-16I of the Railways Act 1993. These provisions, introduced by Section 223 of the Transport Act 2000 but only brought into effect in 2005, allow ORR to direct that enhancements be made to railway facilities. ORR considers the powers to be a last resort to be used only when the commercial incentives existing under its investment framework have failed to deliver a desirable enhancement. ORR warns of likely regulatory delays in the application of these new rights for infrastructure users: "it may, in the handling of early cases, be some time before we are in a position to issue directions".
