Regulation of anti-competitive conduct by airports

Civil Aviation Authority consultation (55 pages, PDF) on the application of Section 41 of the Airports Act 1986 and Section 32 of the Airports (Northern Ireland) Order 1994. These provisions allow the Civil Aviation Authority to investigate specific classes of potentially anti-competitive conduct by airports and to propose conditions to prevent such conduct. The paper highlights overlaps between the Airports Act/Order regime and general competition law enforcement by the OFT (the CAA has no power to apply the Competition Act 1998, Article 81 and Article 82 to airport matters).
