E.ON objects to ORR remedies on EWS coal carriage contracts

Competition Appeal Tribunal summary (2 pages, PDF) of a notice of appeal by the power station operator E.ON UK against the directions given by ORR in its decision that some agreements entered into by the rail freight operator EWS with coal customers (including E.ON) amounted to an abuse of EWS' dominant position.

E.ON alleges that the scope of ORR's directions goes beyond what is necessary to end the infringement, and that the directions are not effective or enforceable because they amount to an obligation on E.ON and EWS to agree with each other.

The deadline for third-party interventions is Thursday 15 February 2007.
