Ofcom's wholesale SMS termination review 2007-2009

Ofcom notice that it intend to conduct a market review under the Communications Act 2003 of the wholesale text termination services offered by UK mobile phone operators. Assuming that Ofcom determines that some or all of these operators have significant market power on the grounds that they do not face actual or potential competitive constraints in delivering SMS messages to their customers, Ofcom will need to consider whether regulatory action, including perhaps price controls, would be proportionate in the light of its statutory duties to "further the interests of citizens in relation to communications matters" and to "further the interests of consumers in relevant markets, where appropriate by promoting competition".
