Role of third parties in UK competition law enforcement

OFT draft guidelines (50 pages, PDF) on the involvement of complainants and third parties in its investigations into potential infringements of Article 81, Article 82 or the Competition Act 1998. Responses by Thursday 19 January 2006.

The document proposes criteria for the OFT to decide on whether to inform, and seek information from, interested parties in the course of competition law investigations. It also proposes categories of information that the OFT would look for in complaints about anti-competitive practices.

Because of the generic nature of the guidelines, the information requested is likely to fall short of what is necessary to define clear terms of reference for the OFT's investigation. Reckon offers a complaint preparation service to fill this gap.
