BritNed interconnector granted 25-year exemption

Ofgem decision (12 pages, PDF) to exempt the proposed BritNed interconnector between England and the Netherlands from regulated third party access requirements and from Article 6(6) of Regulation 1228/2003, which restricts the interconnector operator's ability to take profits from "revenues resulting from the allocation of interconnection". The decision is subject to a possible veto by the European Commission, and can be revoked in the future.

Ofgem's decision describes BritNed's commercial grounds for seeking an exemption in more detail than its September 2006 consultation.
