E.ON appeal against Ofgem's decision on gas exit regime

Summary (4 pages, PDF) of E.ON's appeal against Ofgem's decision (22 pages, PDF) to approve a modification to the gas Uniform Network Code which gives effect to new arrangements for the allocation of exit capacity from the gas National Transmission System. E.ON notes that Ofgem's decision was “opposed by the great majority of industry parties” and alleges that “the Decision amounts to the implementation of Ofgem's ... own project, not the adjudication of a dispute between industry parties”.

The appeal is to be heard by the Competition Commission acting as a tribunal under the Energy Act 2004. The only previous appeal using this procedure was abandoned.
