Albion Water v Ofwat & Welsh (Shotton) [2008] CAT 31

Competition Appeal Tribunal judgment (90 pages, PDF) on allegations of unfair pricing (exploitative abuse) in the Albion Water v Ofwat (Shotton) case.

The Tribunal found that “in March 2001 Dŵr Cymru abused its dominant position by quoting a First Access Price which was both excessive and unfair in itself” and suggested that the parties should now try to negotiate a solution to this dispute in the light of the Tribunal's judgments.

The Tribunal has also released the Ofwat report (227 pages, PDF) produced in June 2007 in response to the Tribunal's December 2006 request, and a schedule of points in dispute (231 landscape pages, PDF) in relation to that Ofwat report.
