Consultation on ORR's approach to reviewing rail markets

ORR consultation paper (25 pages, PDF). The paper summarises ORR's duties for monitoring and reviewing competition in UK rail markets, under the Railways Act 1993, the Enterprise Act 2002, and the EU "first rail package" directives. It sets out ORR's proposed process for market review and highlights factors that will be taken into account in deciding whether to make a reference to the Competition Commission under the Enterprise Act 2002. An annex identifies the main factors that ORR proposes to consider in analysing whether there is effective competition and/or market features which might prevent, restrict or distort competition. Consultees are asked in particular whether ORR's approach "strikes the right balance in expending resources", and to identify markets where "a detailed review by ORR may lead to benefits for the rail industry". Responses by Tuesday 22 November 2005.
