Connections: new wording for non-discrimination condition

Ofgem notice (4 pages, PDF) proposing a revised wording for the electricity distribution standard licence condition 4C (non-discrimination). The proposed wording retains strict prohibitions on discrimination irrespective of its effects (e.g. unfair advantage or exclusion of competitors), and extends them explicitly to non-contestable connection services and information. It also adds a duty to report to Ofgem on compliance. The existing duty not to "restrict, distort or prevent competition in the generation, transmission, distribution or supply of electricity" is also extended to the provision of non-contestable connection services.

This proposal follows from a March 2005 consultation (15 pages, PDF), which in turn was prompted by Ofgem's no grounds for action decision in a Competition Act 1998 case about United Utilities Electricity's conduct.
