OFT and Ofcom reports on Sky/ITV submitted to DTI

OFT press notice reporting that the OFT has found that Sky's acquisition of a shareholding in ITV plc was a relevant merger situation under the Enterprise Act 2002, and that the OFT would have referred it to the Competition Commission if media public interest considerations had not been notified. The Secretary of State has a month to consider this advice and Ofcom's advice on media public interest issues and decide whether to make a reference to the Competition Commission. The OFT and Ofcom reports will be published at that time. (It is the ministerial decision, rather than the OFT or Ofcom advice by itself, which can be subject to judicial review at the Competition Appeal Tribunal.)
