NTL/Telewest merger: OFT clearance decision

OFT decision (9 pages, PDF) not to refer the merger of NTL and Telewest to the Competition Commission. As indicated by the December press notice, the OFT draws attention to the geographic separation between the cable operators' local networks, and adopts the reasoning of the 2000 Competition Commission NTL/C&C report against "benchmark competition, policy or indirect competition". The OFT considered whether the merger created a risk of anti-competitive conduct in pay-TV content supply markets: it did not find sufficient competition concerns to support a reference to the Competition Commission.
