AES Kilroot v NIAUR (Utility Regulator) [2008] NIQB 62

High Court judgment (about 20 pages) refusing an application by the Northern Ireland power station operator AES Kilroot for judicial reviews of the regulator's decision to cancel long-term power purchase agreements in 2010, following the introduction of a wholesale electricity trading system. A regulatory power to force the early termination of the agreements in such circumstances was created at privatisation in 1992. Kilroot's challenges on the grounds of unreasonableness and lack of proper consultation were both rejected by the judge.
