Phoenix Gas "re-opening": ESH complaint against NIAER

Open letter (3 pages, PDF) from East Surrey Holdings (ESH) to the Parliamentary Undersecretary of State for Northern Ireland complaining about the electricity and gas regulator NIAER's alleged failure to honour an "agreement" on valuation and rate of return for ESH subsidiary Phoenix Gas, and NIAER's alleged attempt to facilitate the withdrawal of Terra Firma/Kellen's bid for ESH (a request to withdraw is under consideration by the Takeover Panel). ESH is asking the minister to take action to ensure that NIAER acts within its powers, but is not explicitly threatening any legal action. NIAER has restated its position here and here.
