Welsh Water appeal v CAT: no permission on the papers

Order of the Court of Appeal (4 pages, PDF) refusing permission for Welsh Water to appeal against the CAT judgments in the Albion Water (Shotton) case. Lord Justice Richards considered, on the papers and without a hearing, that an appeal against the CAT's legal analysis would have no real prospect of success. Welsh Water can ask the Court of Appeal to reconsider this decision at a hearing.

Update, July 2007: Permission to appeal has been granted after a hearing. See the Court of Appeal order.
