Albion Water v Ofwat/Welsh Water [2007] CAT 8

Competition Appeal Tribunal judgment (58 pages, PDF) refusing permission for Welsh Water to appeal the Tribunal's judgments quashing an Ofwat non-infringement decision, declaring that Welsh Water had abused a dominant position in its dealings with Albion Water in relation to the Shotton Paper site, and imposing a continuation of interim measures including the imposition of a bulk supply price. The Tribunal held that the appeal had no real prospect of success, and that it was premature as regards exploitative abuse issues, given that Ofwat is due to report to the Tribunal on its further investigation of these issues by Monday 18 June 2007.

Welsh Water can now apply to the Court of Appeal for permission to appeal the Tribunal's judgments. Ofwat had not sought permission to appeal (at this stage).
