Ministry of Defence v Thames Water [2006] EWHC 66 (TCC)

High Court judgment (about 16 pages) on preliminary questions of law in a dispute relating to the allowance to be made for leakage in using water supply metering data to calculate sewerage charges. The judge rejected Thames Water's submissions that its charges scheme could be set without regard to actual leakage rates in customer sites, or that the scheme could prevent recovery of excess charges paid by mistake.

Update, December 2006: Judgment reversed by the Court of Appeal.
