Merger reference for Mid Kent Water / South East Water

OFT notice that the merger between Mid Kent Water and South East Water is being referred to the Competition Commission.

Under the Water mergers legislation, the Competition Commission is to consider the prejudice to Ofwat's ability to make comparisons between water enterprises (rather than the question of substantial lessening of competition).

Update, 20 November 2006: the Competition Commission is seeking initial submissions (2 pages, PDF) by Friday 1 December 2006 and had set-up a dedicated page for this inquiry.

Update, 23 November 2006: Full OFT decision (about 2 pages). This is limited to noting that the test for a mandatory reference under the Water mergers rules is met.
