Independent Water Company v Ofwat [2007] CAT 6

Competition Appeal Tribunal judgment (67 pages, PDF) finding Independent Water Company's appeal to be inadmissible. Independent Water Company (and Albion Water) had complained about Ofwat's alleged failure to enforce competition law in relation to water supplies to a new residential development in the Bristol Water area. The Tribunal found that the process following the complaints to Ofwat did not progress to a point at which it could be said that Ofwat had made a non-infringement decision or refused a valid request for interim measures.
