Discriminatory abuse by Belgian collecting society
Brussels court of appeal judgment (14 pages in French, PDF) allowing a concert organiser to use an Article 82 defence to a claim for recovery of royalties by the copyright collecting society SABAM. The court found that it was an abuse of a dominant position for SABAM to discriminate between concert organisers by offering a 50 per cent discount to organisers who have a three-year unblemished track record and have paid licensing fees in excess of about £8,000.
