Derry City Council v Information Commissioner

Information Tribunal decision (31 pages, PDF) and formerly confidential schedule (6 pages, PDF) ordering Derry City Council (Londonderry's local authority) to disclose under the Freedom of Information Act 2000 information about financial terms offered by the city-owned City of Derry airport to Ryanair. The decision was issued on Monday 11 December 2006 but only published in full (including confidential information) on Wednesday 7 March 2007, on the expiry of the time for an appeal to be brought.

Although the European Commission cleared some infrastructure funding in 2006, it seems possible that other payments to Ryanair may be classified as unnotified and illegal State aid.

The Tribunal's decision provides a detailed analysis of the application of the commercial interest and confidentiality exclusions under the Freedom of Information Act 2000.
