Green Paper on damages under EC competition law

European Commission consultation (12 pages, PDF) on facilitating private claims for damages for infringements of EC competition law. The paper does not consider private enforcement of competition law through injunctions, competition defences or any other means — the main focus appears to be on cartel damages.

The paper is essentially a list of high-level ideas with no analysis of their feasibility within national judicial systems, or indeed of their relevance (for example the paper assumes that split actions with a trial for liability before any trial for quantum would be something new). A number of the ideas concern matters that are currently governed by national rules of procedure. There is even a suggestion of creating a Community right to penal damages for horizontal cartels. Responses by Friday 21 April 2006.
