ORR decision on possession planning dispute

ORR decision (10 pages, PDF) quashing a Timetabling Panel decision that had endorsed a short-notice possession taken by Network Rail in circumstances where it could and should have shared information with operators earlier. The freight operators who brought the appeal to ORR appeared mainly concerned with obtaining a declaration that this was not a proper way for Network Rail to alter the rules of the plan. There appears to be no discussion in the ruling or background papers of any financial implication of the dispute (i.e. whether affected operators are entitled to compensation on the basis of the operational performance regime for disruption caused by the possession).
