Excessive charging encompasses a diverse set of rules and concepts. To be useful, economic analysis needs to be based on a detailed analysis of the specific notion of excessive charging relevant to the case.
In many cases this will involve an in-depth review of the case law and regulatory precedents.
We are familiar with the concepts of excessive charges that exist in several contexts:
- Price controls, for example in the utility and transport sectors.
- Competition law: exploitative abuse and margin squeeze.
- The distinction between legitimate liquidated damages and unfair penalty charges under the Unfair Terms in Consumer Contracts Regulations 1999 or the common law.
We can advise on all aspects of developing cost projections or estimates of total or unit revenue requirements.
Our capabilities include demand forecasting using econometric analysis, estimation of the cost of capital and other financing costs, and efficiency studies.
